Terms of Service

These terms govern your use of ForgeForm — the app, your account, subscriptions and Coach Credits, and the limits of AI-generated plans.

1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and Borges Realty LLC d/b/a ForgeForm.FIT, a Florida limited liability company ("ForgeForm", "we", "us"), governing your use of the ForgeForm app and this website. By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 16 years old to use ForgeForm. By using the App you represent that you are 16 or older. If you are under 18, you represent that your parent or legal guardian has reviewed these Terms and agreed to them on your behalf, and that they accept responsibility for your use of the App and for any charges made through your account.

3. Your account

You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity under your account. Notify us promptly at support@forgeform.fit if you suspect unauthorized use.

4. The service

ForgeForm generates and adapts personalized workout and nutrition plans using AI, lets you log and track training, calculates Sleep and Recovery scores from data you allow it to read from Apple Health, and offers social features such as friends, squads, and an activity feed. Features may change, be added, or be removed over time. We may impose reasonable usage limits (for example, on the number of AI plan generations available under your plan or credits).

5. Subscriptions, Coach Credits & payments

Some features require a paid subscription, the one-time Founders purchase, or "Coach Credits" (a limited, revocable license to generate or update an AI plan). Prices and what each tier includes are shown in the App before purchase.

• What we sell. ForgeForm offers auto-renewing Plus and Pro subscriptions (each available monthly or annually), a limited one-time Founders purchase, and, from time to time, consumable Coach Credit packs.
• Billing through Apple. Purchases are processed by Apple through your App Store account. Payment is charged at confirmation of purchase.
• Auto-renewal & free trials. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. Where a free trial is offered, billing begins when the trial ends unless you cancel before then. Manage or cancel a subscription in your Apple ID settings; deleting the App does not cancel a subscription.
• Unlimited tiers & fair use. Plus and Pro include unlimited AI plan generation, plan edits, and coach chat, provided for personal, human, in-app use. Automated, scripted, shared-account, or extraction-scale use — or usage patterns far exceeding any plausible personal training need — may be rate-limited, suspended, or revoked; we will only rely on this to protect the service against abuse, never against ordinary heavy use by a real person. Response quality and AI model selection may vary with load and usage; no specific model is promised for any given request.
• Founders (lifetime) purchase. The Founders seat is a one-time purchase, not a subscription — it does not auto-renew and no recurring charge is made. "Lifetime" means the lifetime of the ForgeForm service — for as long as ForgeForm remains commercially operated — not the lifetime of the purchaser. Founders receive all Pro-tier benefits, subject to fair use. Benefits are defined as of the time of purchase and may be reasonably modified, substituted, or improved as the service evolves, provided the overall value of the tier is preserved. Seats are limited in quantity, tied to your ForgeForm account, and non-transferable and non-resalable; deleting your account permanently forfeits the entitlement.
• Coach Credits. Credits fund AI plan generations for users without a subscription. They have no cash value, are non-transferable, do not expire, and are not refundable once used. Amounts charged per action are shown in the App and may be adjusted prospectively. Subscribers are never charged credits.
• Refunds. Refund requests for App Store purchases are made to and decided by Apple under its terms. If a purchase is refunded, the corresponding credits or entitlement (including a Founders seat or subscription benefits) will be revoked, and credit balances may become negative to reflect credits already spent.
• Entitlements are account-based. Purchases are linked to your ForgeForm account on our servers. Reinstalling the App or moving devices requires signing in to the same account; "Restore Purchases" re-links Apple-side purchases where applicable.
• Changes to pricing. We may change prices of future purchases prospectively; changes do not affect a subscription period you have already paid for.
• Beta & early access. Any beta access, free allowance, or early-access pass is limited, offered at our discretion, and may be withdrawn as the service moves to general availability.

6. AI-generated content

Workout and nutrition plans, adjustments, and recovery guidance are generated by automated systems based on the information you provide. They are general suggestions, not professional, medical, or dietary advice, and may contain errors, omissions, or exercises unsuitable for you. You are responsible for exercising your own judgment, scaling or skipping anything that is inappropriate for your condition, and consulting a qualified professional. 7. Health & safety; assumption of risk

Physical exercise carries inherent risks, including serious injury. By using ForgeForm you acknowledge these risks and agree that you participate voluntarily and at your own risk. Do not use the App as a substitute for professional medical care. See the full Health & Fitness Disclaimer.

8. Your content & conduct

You retain ownership of the content you create (workouts, posts, photos, comments). You grant us a limited, worldwide, non-exclusive license to host, store, display, and share that content solely to operate the App's features you use — for example, showing a workout you post to friends in your feed. You agree not to: post unlawful, harassing, hateful, or infringing content; impersonate others; harvest data about other users; or interfere with or attempt to breach the App's security. We may remove content or suspend accounts that violate these Terms.

9. Intellectual property

The ForgeForm app, brand, logo, design, and underlying software are owned by ForgeForm and protected by law. We grant you a personal, non-transferable, revocable license to use the App for your own non-commercial use, subject to these Terms. You may not copy, modify, reverse-engineer, or resell the App or its content except as permitted by law.

10. Third-party services

ForgeForm relies on third-party services, including Apple (App Store, HealthKit), RevenueCat (purchase and subscription management), and Supabase (hosting). Your use of those services is also subject to their terms. We are not responsible for third-party services outside our control.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated plans will meet your goals or be suitable for you. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, ForgeForm and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, loss of data, or lost profits arising from your use of (or inability to use) the App. To the extent liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You agree to indemnify and hold harmless ForgeForm from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the App, your content, or your violation of these Terms or of any law or third-party right.

14. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if required to protect the App or other users. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, and indemnification) will survive.

15. Governing law & disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply. Before filing any formal claim, you agree to first contact us at support@forgeform.fit so we can try to resolve the matter informally. Any dispute not resolved informally will be subject to the courts located in Florida, unless mandatory local law provides otherwise.

16. Apple App Store additional terms

These Terms are between you and ForgeForm only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App, and any claims relating to the App are our responsibility, not Apple's. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

17. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, an in-app notice. Your continued use after an update means you accept the revised Terms.
